本使用條款由烏夏數位文創娛樂股份有限公司(下稱「本公司」)就其提供之【故事迷(X Stories)】行動應用程式及其相關之網站與服務(合稱「本服務」)所訂定。 These Terms of Use (the “Terms”) are established by Usha Digital Culture & Creative Entertainment Co., Ltd. (the “Company”) for the X Stories mobile application, its related websites and associated services (collectively, the “Service”).

You understand and agree that any new features, content, activities, or tools introduced within the Service in the future will also be governed by these Terms.

Revisions will be announced via in-Service notices or by other reasonable means and will take effect upon posting. Your continued access to or use of the Service after the effective date constitutes your acknowledgment and acceptance of the changes. To the extent permitted by law, we shall not be liable for any loss, inconvenience, or unavailability of data or features arising therefrom. If you do not agree to the revisions, please stop using and uninstall the application. We recommend that you check the latest version of the Terms periodically, so that you are aware of the terms applicable at that time.

If you obtain the Service from unauthorized or unofficial sources, you assume any related risks and losses.

To the extent permitted by law, the parties agree to exclude the contra proferentem rule (i.e., these Terms shall not be construed against the drafter). The legal guardian shall be responsible for your use of the Service and any related charges. You also represent that you have capacity to contract; if you use the Service on behalf of an entity, you warrant that you are duly authorized.

您應妥善保管帳號與密碼,不得與任何人共享或提供登入資訊,亦不得轉借、出租、出售、交易或以其他方式移轉帳號。無論您是否知悉,於您帳號下所為之一切行為,由您自行承擔責任;如發現未經授權之使用或其他資安事件,您應立即通知我們,我們得採取合理必要之措施。 You must keep your account credentials secure and confidential. You must not share your login credentials or lend, rent, sell, trade, or otherwise transfer your account. You are responsible for all activities under your account, whether or not authorized by you. If you discover unauthorized use or other security incidents, you must notify us immediately; we may take reasonable and necessary measures.

To the extent permitted by law, you assume such risks and damages arising therefrom. If future features require additional device permissions, the Service will request necessary system permissions. You may revoke them in your device settings; however, related features may become unavailable or degraded. We are not liable, to the extent permitted by law, where hardware conditions, system settings, communication/network quality, or third-party interference cause inaccuracy or unavailability.

本服務為結合敘事文本與多媒體互動之應用程式,提供沉浸式閱讀與互動選擇體驗,本版本不提供使用者內容上傳、發布或社群互動之功能。 The Service combines narrative text with multimedia interactivity to deliver immersive reading with interactive choices. The current version does not offer user uploads, publishing, or social features.
本服務採代幣包購買與閱讀解鎖機制,您可透過代幣加值以解鎖故事內容或素材,不提供單本購買或訂閱制。 The Service uses token pack purchases and unlock-to-read mechanisms. You may top up tokens to unlock story content or assets. Single-title purchases or subscriptions are not currently offered.
為提供與改進本服務,可能整合第三方服務與工具。第三方服務之條款與政策由其提供者訂定,使用前請詳閱相關條款。 To provide and improve the Service, we may integrate third-party services and tools. Such services are governed by their providers’ terms and policies; review them before use.
基於法規或商業考量,特定功能可能於部分地區或版本不提供或受限制,一切以本服務內之實際呈現與說明為準。 For regulatory or commercial reasons, certain features may be unavailable or restricted in some regions or versions. In all cases, the in-Service presentation and descriptions prevail.

除法律允許且經法定代理人明示同意並直接監督外,我們不會明知而蒐集 未滿13歲之兒童個人資料;若發現誤收,將於可行範圍內儘速刪除。若當地法令就兒少資料保護另有更高年齡門檻,從其規定。 We do not knowingly collect personal data from children under 13 except as permitted by law and with the express consent and direct supervision of a legal guardian. If we discover inadvertent collection, we will delete it as promptly as feasible. If local law imposes a higher age threshold for children’s data, that rule prevails.

本服務之付費交易係由應用商店或其他合作金流服務處理;請確保您的付款帳戶與帳單資料為最新且正確。 Payments are processed by app stores or other payment partners. Please ensure your billing account and payment information are current and accurate.
本服務及其內容包含但不限於:軟體程式原始碼與目標碼、系統架構與其組件、資料庫、使用者介面/體驗(UI/UX)、整體外觀與感受(look & feel)、設計與版面配置、文字、行銷文案、音訊、影像、圖像與圖示、文件與資料彙編,以及本服務所使用或展示之名稱、標誌、商標及服務標章(合稱「平台內容」),均受著作權、商標權及其他智慧財產權或相關法律保護,其權利由本公司或其授權人所享有。除法律另有強制規定或本條款明示授權外,任何權利均不因此移轉予您。 The Service and its contents—including without limitation source code and object code, system architecture and components, databases, UI/UX, look and feel, design and layout, text, marketing copy, audio, video, images and icons, documents and compilations, and any names, logos, trademarks, and service marks used or displayed by the Service (collectively, “Platform Content”)—are protected by copyright, trademark, and other IP or related laws. Rights are owned by the Company or its licensors. Except as required by law or expressly licensed herein, no rights are transferred to you.

To enable a smooth experience, the Service may create temporary or offline caches on your device; such caches are for in-Service playback only, do not transfer ownership or other rights, and may be deleted upon sign-out, removal, or expiration.

本服務內所使用或展示之名稱、商號、商標、服務標章、標誌與相關識別(合稱「標誌」)屬本公司或其授權人所有。【故事迷(X Stories)】、【X Studio】、【烏夏數位文創娛樂股份有限公司】及其各自之標誌,均為本公司之商標、服務標章或商號識別。未經本公司事前書面同意,您不得以任何方式使用、展示、註冊或將之作為網域名稱、社群帳號或中繼資料,亦不得於任何網站、應用或程式碼中使用本公司之標誌作為metatags/關鍵字或足以損及本公司商譽之方式使用。第三方之標誌僅為識別之用,其權利屬各權利人所有。 Names, trade names, trademarks, service marks, logos, and related identifiers used or displayed in the Service (collectively, “Marks”) are owned by the Company or its licensors. X Stories, X Studio, and Usha Digital Culture & Creative Entertainment Co., Ltd. and their respective marks are trademarks, service marks, or business identifiers of the Company. Without prior written consent, you must not use, display, register, or apply Marks as domain names, social accounts, or metadata/keywords, nor use them in any manner that dilutes, tarnishes, or otherwise harms the Company’s goodwill. Third-party Marks are for identification only and remain the property of their owners.

Aside from necessary display of basic account identifiers (e.g., nickname) that must be displayed within the Service, user information you provide will not be disclosed to other users unless required by law or with your consent. We will not use your user information for off-platform marketing or separate commercial exploitation.

Backups or technical caches may delay deletion. After account deletion or termination, unless otherwise required by law, we have no obligation to restore or export any content or data.

收到合格通知後,我們於審查或待釐清期間,得於不事先通知之情況下,採取包含但不限於移除、下架、限制存取或以區域方式限制之措施,並得視情況轉知相關內容提供方或主管機關。若後續確認無侵權,我們得視情況恢復相關內容或解除限制,惟不保證恢復或維持任何特定內容之可用性。對於明顯濫用或重複不實主張之通知,我們得不予受理。本條不影響我們依法可主張之其他救濟。 Upon receipt of a qualifying notice, during review or clarification and without prior notice, we may remove, delist, restrict access, or apply regional restrictions, and where appropriate notify providers or authorities. If no infringement is found after review, we may restore content or lift restrictions at our discretion, without guaranteeing availability of any particular content. We may decline abusive or repeatedly unfounded notices. This section does not limit other remedies available by law.

(1) 違法或侵權內容 a. Unlawful or Infringing Content
於任何輸入欄位提供或以任何方式使用侵害他人權利之內容;鼓吹、協助或宣傳違法行為;發布誹謗、仇恨、歧視、騷擾、暴力、猥褻、露骨色情、自我傷害鼓勵、詐騙或其他令人反感內容。 Providing or using content that infringes others’ rights; promoting, assisting, or advocating illegal conduct; publishing defamatory, hateful, discriminatory, harassing, violent, obscene, sexually explicit content; content encouraging self-harm; fraud or otherwise objectionable content.
(2) 資安與系統濫用 b. Security and System Abuse
散布病毒、惡意程式或執行任何干擾、破壞、使本服務或其相關網路/設備過度負載之行為;未經授權之存取、掃描或安全測試、負載壓測、DDoS/DoS攻擊、流量洪泛、繞過存取控制或安全機制傳送或注入檔案、影像、音訊、連結等內容或可執行程式至本服務等行為;生成或嘗試生成勒索軟體、鍵盤側錄程式等有害軟體。 Distributing viruses or malware; any act that interferes with, damages, or overloads the Service or related networks/devices; unauthorized access, scanning or security testing, load testing, DDoS/DoS, traffic flooding; bypassing access controls or security mechanisms to transmit or inject files, images, audio, links, or executables into the Service; generating or attempting to generate ransomware, keyloggers, or other harmful software.
(3) 自動化濫用與垃圾行為 c. Automation Abuse and Spam
以bot、爬蟲、抓取程式等自動化工具、巨集、腳本存取或蒐集本服務內容;傳送或誘發垃圾訊息、釣魚、詐騙或未經請求的大量訊息;以任何方式對本服務之基礎設施造成不合理負載,或干擾服務運作。 Accessing or collecting Service content via automated tools such as bots, crawlers, or scripts; sending or triggering spam, phishing, fraud, or unsolicited bulk messages; causing unreasonable load or interfering with operation.
(4) 內容擷取與逆向 d. Content Extraction and Reverse Engineering

Unless otherwise required by law or app-store rules, adjustments apply from the effective date stated in the notice; your continued use after the effective date constitutes consent. If adjustments require providing equivalent value or reasonable substitutes for unused balances or acquired Virtual Items, we will handle them in accordance with in-Service instructions. In cases of obvious pricing/display errors or system faults, we may cancel or correct the transaction and refund the amount actually paid or an equivalent value in Virtual Currency, as appropriate.

所有付款、取消與退款,均依您所使用之應用商店流程與規則辦理。 All payments, cancellations, and refunds follow the processes and rules of the applicable app store.
(4) 在地強制法d. Local Mandatory Law
若適用地方法令就數位內容另有強制規定,從其規定,但如於付款頁明確揭示「使用者同意立即提供數位內容而放棄解除權」且我們已開始提供,則不適用冷靜期/鑑賞期解除。 If local laws impose mandatory rules on digital content, those rules prevail; however, if the payment page clearly discloses “the user agrees to immediate provision of digital content and waives the right of withdrawal” and we have begun providing the content, the cooling-off/right-to-withdrawal does not apply.

We may cancel or void related Virtual Items, cancel transactions, restrict or suspend accounts, and reserve the right to pursue remedies, as appropriate.
如我們合理懷疑存在未經授權之付款、盜刷、信用卡爭議/回沖、異常交易、漏洞濫用、場外交易/代儲或其他違規情事,本公司得採取包括但不限於:作廢或扣回虛擬貨幣/虛擬商品、限制或暫停帳號、終止服務存取、取消交易等必要措施,並保留依法主張一切救濟之權利。 If we reasonably suspect unauthorized payments, card theft, chargebacks or payment disputes, irregular transactions, exploit abuse, off-platform trades/proxy top-ups, or other violations, we may take necessary measures including without limitation voiding or clawing back Virtual Currency/Items, canceling transactions, restricting or suspending accounts, terminating access to the Service, and we reserve all legal remedies.
若您的帳號被停權、依本條款終止或本服務全部或部分中止時,您未使用之虛擬貨幣與虛擬商品可能失效或被移除;法律或應用商店規則另有規定者,從其規定。 If your account is suspended or terminated under these Terms, or the Service is wholly or partially discontinued, unused Virtual Currency and Virtual Items may become invalid or be removed. Where laws or app-store rules provide otherwise, such rules prevail.

If any content is removed or becomes available, you may no longer be able to access such content. Except where required by applicable law, Virtual Currency will not be refunded. The Company has no obligation to continue providing or to reintroduce any content.

We may preserve evidence, require identity verification, or notify and cooperate with authorities where required by law or appropriate.
您得隨時停止使用本服務。僅移除應用程式不會取消您於應用商店的內購;您須依應用商店機制辦理取消。已付款項與已取得之數位內容(含虛擬貨幣/虛擬商品)之處理,悉依本條款相關章節辦理。 You may stop using the Service at any time. Removing the application does not cancel in-app purchases made via app stores; you must cancel according to the app store’s process. Handling of amounts already paid and acquired digital content (including Virtual Currency/Items) is governed by the relevant sections of these Terms.
於終止或停權後:Upon termination or suspension:
(1) 授與您之各項權利與授權即告終止;a. All rights and licenses granted to you terminate immediately;
(2) 您應立即停止使用本服務,並(如有需要)自裝置解除安裝本應用程式; b. You must immediately stop using the Service and, if applicable, uninstall the application from your devices;
(3) 未使用之虛擬貨幣或虛擬商品可能失效或被移除,恕不退款,除非適用法令或應用商店規則另有強制規定; c. Unused Virtual Currency or Virtual Items may expire or be removed, without refunds, unless otherwise mandatorily required by law or app-store rules;
(4) 我們得依本服務之《隱私政策》與資料保存政策,在合理期間內保留必要紀錄以符合法律義務、爭議處理或防制濫用;除法律另有規定外,我們無義務為您恢復或匯出任何內容或資料。 d. Per the Privacy Policy and data retention policies, we may retain necessary records for a reasonable period to comply with legal obligations, handle disputes, or prevent abuse. Unless required by law, we have no obligation to restore or export any content or data.
依適用法令允許之最大範圍,我們對因服務之修改、暫停、終止或您帳號之限制/停權所生之任何損害不負責任。對於違反本條款、政策或法令之情形,我們仍得依法主張損害賠償、禁制或其他救濟;任何延遲或未行使權利不構成放棄。 To the maximum extent permitted by law, we are not liable for damages arising from modifications, suspension, termination of the Service, or from restrictions/suspension of your account. We may still seek damages, injunctions, or other remedies for violations of these Terms, policies, or laws; any delay or failure to enforce is not a waiver.
即使本服務或您帳號終止,關於智慧財產權、虛擬貨幣/商品之性質與限制、使用限制、保固免責、責任限制、賠償、準據法與爭議解決、第三方條款/外部連結、資料保存與隱私等規定,仍於終止後持續有效。 Even after termination of the Service or your account, provisions concerning intellectual property, the nature and limitations of Virtual Currency/Items, use restrictions, warranty disclaimers, liability limitations, indemnification, governing law and dispute resolution, third-party terms/links, data retention, and privacy survive termination.
為維持安全、法遵與服務品質,我們得要求您安裝更新或新版;未完成更新者,部分或全部功能可能無法使用。 To maintain security, compliance, and service quality, we may require you to install updates or new versions. Without updating, some or all features may be unavailable.
於法律允許範圍內,我們得於不事先通知之情形下,隨時停止全部或部分服務,並得限制、暫停或終止您的帳號存取。 To the extent permitted by law, we may discontinue all or part of the Service and may restrict, suspend, or terminate your access to your account, in each case without prior notice.
如帳號連續12個月未登入或無使用紀錄,我們得停用或刪除帳號及其資料(依法需保存者除外)。 If an account has no login or usage for 12 consecutive months, we may deactivate or delete the account and its data (except where retention is legally required).
帳號遭停權、終止或刪除,或本服務全部或部分停止時,已支付費用與未使用之數位內容(含虛擬貨幣/虛擬商品)原則上不予退款,除非適用法律或應用商店規則另有強制規定。 If an account is suspended, terminated, or deleted, or if the Service is wholly or partially discontinued, payments already paid and unused digital content (including Virtual Currency/Items) are generally non-refundable, unless mandatorily required by law or app-store rules.
在提出任何法律行動前,雙方應先以書面善意協商至少30日;請將爭議事由與聯絡方式寄至 [email protected];以本公司實際收受您寄發電子郵件之日期為協商期起算基準。 Before initiating any legal action, the parties shall first engage in good-faith written negotiations for at least 30 days. Please email your dispute details and contact information to [email protected]. The negotiation period begins on the date we receive your email.
除非強制法另有規定,本條款受臺灣地區法律管轄並依其解釋,不適用其衝突法規則與《聯合國國際貨物買賣公約》。 Unless mandatory law provides otherwise, these Terms are governed by and construed under the laws of the place where the Company is registered, without regard to its conflict-of-laws rules and the United Nations Convention on Contracts for the International Sale of Goods (CISG).
(1) 法院管轄a. Courts Jurisdiction
除消費者保護法另有強制規定外,您與本公司同意以臺灣臺北地方法院為第一審管轄法院。 Except where consumer-protection law mandates otherwise, you and the Company agree that the Taipei District Court, Taiwan, shall have jurisdiction as the court of first instance.
(2) 禁制令例外b. Injunctive Relief
為防止未經授權使用或侵害智慧財產、資料安全與保密義務,任一方得向有管轄權法院聲請即時禁制或衡平救濟。 To prevent unauthorized use or protect intellectual property, data security, or confidentiality, either party may seek immediate injunctive or equitable relief from a court of competent jurisdiction.
(3) 地區化調整c. Regional Adjustments
本公司得視業務發展及適用法令需要,修訂或新增特定地區之爭議處理機制。 The Company may, based on business development and applicable laws, amend or introduce region-specific dispute mechanisms.
在法律允許的最大範圍內,任何請求或訴因須於發生後1年內提出,逾期視為拋棄;法律禁止時不在此限。 To the maximum extent permitted by law, any claim or cause of action must be brought within one (1) year after it accrues; otherwise it is time-barred. Where prohibited by law, this limitation period does not apply.
本條款以繁體中文為準;其他語言版本僅供參考。若與消費者所在地之強制規定相牴觸者,從其規定。 This English version is provided for convenience only. In the event of any discrepancy, the Traditional Chinese version shall prevail. To the extent mandatory consumer-protection rules of your jurisdiction require otherwise, those mandatory rules prevail.
若本條款之任何規定在任何法域被認定為違法、無效或不可執行,該規定應在必要之最小範圍內限縮或視為刪除,其餘規定之效力不受影響,並於法律允許之最大範圍內繼續適用。 If any provision of these Terms is found unlawful, invalid, or unenforceable in any jurisdiction, that provision shall be limited to the minimum extent necessary or, if such limitation is not possible, deemed deleted, without affecting the validity or enforceability of the remaining provisions, which continue to apply to the maximum extent permitted by law.
未經本公司書面同意,您不得將本條款之地位或其下任何權利義務轉讓、移轉、讓與、委任或以其他方式處分,亦不得轉讓、出借或分享帳號;任何未經授權之處分均屬無效。本公司得於不須另行通知或取得您同意之情形下,因合併、收購、組織重整、股權或資產交易等事由,將本條款之地位或其下權利義務轉讓、移轉或委任予第三人,並得為履約目的而分包或委外;惟對受託人之行為仍負相應責任。本條款對雙方之承受人與受讓人均具有拘束力並使其受益。 Without the Company’s written consent, you may not assign, transfer, novate, delegate, or otherwise dispose of these Terms or any rights/obligations hereunder, nor may you transfer, lend, or share your account. Any unauthorized disposition is void. Without notice to or consent from you, the Company may assign, transfer, or delegate these Terms or any rights/obligations to a third party due to merger, acquisition, reorganization, equity or asset transactions, and we may subcontract or outsource for performance; we remain responsible for the acts and omissions of our subcontractors. These Terms are binding upon and inure to the benefit of the parties’ successors and assigns.
雙方為獨立契約當事人,不構成僱傭、合夥、代理、合資或受託關係。除「Apple附加條款(僅iOS適用)」另有規定外,本條款不創設任何第三方受益人。 The parties are independent contracting parties, and no employment, partnership, agency, joint venture, or fiduciary relationship is created. Except as set out in the “Apple-Specific Terms (iOS Only)”, these Terms create no third-party beneficiaries.
